My Family Bill retains the authority to amend these Terms periodically and at its sole discretion. In the event of substantial modifications to these Terms, we will revise the "Last Modified" date at the commencement of these Terms. Your continuous utilization of the Services subsequent to the publication of revised Terms demonstrates your acknowledgement and acceptance of the changes, thereby signifying your compliance with the updated Terms. You are expected to periodically review these Terms – we strongly advise checking the Terms each time you access the Services – to ensure you remain apprised of any revisions. All alterations to these Terms will take effect from the date of publication, unless communicated otherwise in writing by using or using the Services, or by clicking a button or checking a box marked “I Agree” (or something similar), you signify that you have read, understood, and agree to be bound by these Terms. Please read these Terms carefully to ensure that you understand each provision before accessing or using the Services. If you do not want to agree to these Terms, you must not use or otherwise access the Services.

1. My Family Bill Services

My Family Bill has developed the Services as a technologically advanced solutions with the primary objective of aiding patients in securing reimbursements for legitimate healthcare claims and, whenever feasible, negotiating valid medical bills to curtail their personal medical costs. This encompasses not only the negotiation but also the payment of bills via the Service. It's crucial to note that no monetary transactions occur through accounts owned by My Family Bill during the processing of these payments. In cases where the fulfillment of our responsibility to you requires My Family Bill to engage with third parties, such as submitting claims or interfacing with a hospital, you hereby grant My Family Bill the authorization to act as your representative in the execution of the Service.

2. Eligibility

The Site is offered and available to users who are 18 years of age or older, and reside in the United States or any of its territories or possessions. By using the Site, you represent and warrant that you are of legal age to form a binding contract with Company and meet all of the foregoing eligibility requirements. However, specific bills for people under the age of 18 will have to be signed by their legal representative or guardian for them to utilize our services. If you do not meet all of these requirements, you must not access or use the Site.

You also understand and agree that My Family Bill makes no submission about the suitability, reliability, availability, timeliness, and accuracy of the information, products, services, and related graphics contained within the site.

3. Accessing the Site and Account Security

3.1. We retain the right to withdraw or modify the Site, along with any services or content we furnish on the Site, as determined solely by us without prior notice. We shall not be held liable in the event that any or all sections of the Site become temporarily or permanently inaccessible for any reason or duration. Periodically, access to specific segments of the Site or the entire Site may be restricted to particular users, including registered ones.

3.2. Your responsibilities encompass:

  1. Arranging all prerequisites necessary to access the Site.

You agree to promptly notify us about any unauthorized use of your user name, password, or any breach of security. Moreover, you undertake to ensure that you log out of your account at the conclusion of each session. Exercise additional caution when accessing your account from a shared or public computer to prevent the exposure or recording of your password or personal data by others.

3.4. We possess the authority to deactivate any user name, password, or other identifier—whether chosen by you or provided by us—at our discretion, at any time, for any reason or without reason. This includes instances where, in our judgment, you have violated any stipulation in these Terms of Use.

You have the option to reach out to Customer Support through the contact details available on our Site. Please note that the availability of customer support is neither obligatory nor assured, and its provision is subject to the sole discretion of My Family Bill.

5. Termination

We retain the authority to promptly conclude or temporarily suspend the Service, your utilization of the Service, or your Account, at any given time and for any rationale, including, but not limited to, the following scenarios: (i) your violation of these Terms; (ii) legal requirements that necessitate such action; or (iii) our choice to discontinue the Service. Furthermore, we maintain the prerogative to terminate or suspend the Service, your use of the Service, or your Account without a specific reason. You also possess the right to conclude your use of the Service and your Account at any point in time.

6. Notices

6.1. We may provide notices to you by: (a) emailing them to your Account’s email address or (b) mailing them via courier or regular mail to your Account’s street address. You may provide notices to us via email at: help@myfamilybill.com

6.2. Notices sent by email will be deemed received upon receipt unless a party receives notice that the email was not delivered. Notices sent by courier will be deemed received upon actual receipt. Notices sent by regular mail will be deemed received three (3) business days after deposit in the mail with first-class postage prepaid.

7. Proprietary Information and Intellectual Property Rights

7.1. Reservation of Rights.

The content available on this Site, encompassing software, images, written materials, and other components (referred to as "Content"), constitutes the intellectual property of the Company, safeguarded under copyright, trademark, and other intellectual property laws in the United States and/or other jurisdictions (collectively termed "Intellectual Property Laws"). The download, printing, or any form of usage or reproduction of the Content is prohibited, except within the scope of viewing the Site online for lawful purposes. You may create individual copies of specific Site pages for personal use only, and such copies must not be distributed or posted on any other website. You are also forbidden from altering, renting, leasing, loaning, selling, distributing, or generating derivative works based on any Content. Breaching applicable Intellectual Property Laws could result in civil and/or criminal penalties. No ownership, title, or interest in any downloaded materials is transferred to you beyond the granted license for personal possession.

In the event that you print, copy, modify, download, or utilize any part of the Site in contravention of the Terms of Use, your authorization to use the Site will be immediately revoked, and you are obligated, at our discretion, to either return or destroy any copies of the materials you have generated.

The name of the Company, the Company's logos, and all associated names, logos, product and service designations, visual designs, and slogans are trademarks owned by the Company, its affiliates, or licensors. You are not permitted to utilize these marks without the Company's prior written consent. All other names, logos, product and service designations, visual designs, and slogans on the Site belong to their respective owners and are also considered trademarks.

7.2. Marks.

Without limiting the generality of the foregoing, except to the extent expressly permitted herein, you may not use or display My Family Bill’s names, logos, trademarks, service marks, designs, slogans, domain names or URLs, or other business identifiers (collectively, “Marks”), nor the Marks of My Family Bill’s affiliates or licensors, nor any other Marks that may be contained in the Products and Services, without the prior written permission of My Family Bill. Any use by you of a Mark, and all goodwill associated therewith, will inure solely to the benefit of such Mark’s owner. Except to the extent expressly permitted herein, you may not issue any public announcement or press release, nor make any other promotional effort, in connection with the Products and Services and/or your relationship with us, without our prior written approval.

7.3. Feedback.

You may choose to, or we may invite you to, submit suggestions, ideas, comments, or other feedback about the Products and Services, including, without limitation, about how to improve the Products and Services or any other My Family Bill products and services (“Feedback”). To the extent you provide(s) us with any Feedback, you acknowledge and agree that we will own such Feedback, and you hereby assign to us, on behalf of yourself, all rights (including all Intellectual Property Rights), title, and interest in and to such Feedback. To the extent that the foregoing assignment cannot, as a matter of law, be accomplished, you hereby grant to us, on behalf of yourself, an exclusive, perpetual, irrevocable, royalty free, sub-licensable (through multiple tiers of sub-licensees), transferable, and worldwide license to make, have made, use, import, offer for sale, sell, reproduce, distribute, modify, adapt, prepare derivative works of, display, perform, and otherwise exploit such Feedback in any way, without any restrictions, fees, or attribution or other obligations to you.

8. Restrictions

8.1. You shall not post, transmit or make available in any way through the Site any software or other materials which contain a computer virus, trojan horse, time bomb, or worm, or make any other change in the Content appearing on the Site without the prior written consent of Company (“Rogue Programming.”) Company has no obligation to detect the presence of any Rogue Programming. Any downloading or any other use of the Information on the Site is at your risk, and you are advised to take adequate precautions to minimize any loss to your system caused by Rogue Programming, including use of anti-virus programs and proper backup of files.

8.2. You also agree not to engage in any of the following prohibited activities in connection with the Products and Services:

  1. Copying, distributing, or disclosing any part of the Products and Services in any medium, including, without limitation, by any automated or non-automated “scraping”;
  2. Using any automated system, including, without limitation, “robots,” “spiders,” “offline readers,” etc., to access the Products and Services in a manner that sends more request messages to our servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (except that My Family Bill grants the operators of public search engines revocable permission to use spiders to copy publicly available materials from the Site for the sole purpose of, and solely to the extent necessary for, creating publicly available searchable indices of the materials, but not caches or archives of such materials);
  3. Transmitting spam, chain letters, or other unsolicited email, or otherwise violating any anti-spam, consumer protection, or privacy law, rule, or regulation;
  4. Attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Products and Services;
  5. Taking any action that imposes, or that may, in our opinion, impose, an unreasonable or disproportionately large load on our infrastructure;
  6. Uploading invalid data, viruses, worms, or other software agents through the Products and Services;
  7. Collecting or harvesting any Personal Information of any other user of the Products and Services;
  8. Using the Products and Services for any commercial solicitation purposes;
  9. Interfering with the proper working of the Products and Services;
  10. Accessing any content on the Products and Services through any technology or means other than those provided via the Site; or
  11. Bypassing any measures we may use to prevent or restrict access to the Products and Services, including, without limitation, features that prevent or restrict use or copying of any content or enforce limitations on the use of the Products and Services or the content therein.

9. Monitoring and Enforcement; Termination

9.1. My Family Bill retains the prerogative, without undermining its lawful or equitable rights and without limiting the scope of any other provisions within these Terms, to take the following actions with or without prior notice:

  1. Initiate appropriate legal proceedings, including but not restricted to referring cases to law enforcement, against any instance of illegal or unauthorized utilization of the Products and Services.
  2. Implement alterations to the Products and Services, cease the provision of the Products and Services, or any of their features, to you or the general user base, or set usage limits for the Products and Services.
  3. Suspend or terminate your User Account and/or your access to all or specific sections of the Products and Services.

9.2. In the event of termination, irrespective of the reason, you remain bound by these Terms.

9.3. In addition to the preceding, we reserve the right to fully collaborate with law enforcement entities, regulatory bodies, and/or administrative or court orders that necessitate or instruct the disclosure of the identity or other details of any individual or entity using, accessing, or posting materials through the Products and Services. YOU HEREBY WAIVE, ON YOUR BEHALF AND ON BEHALF OF ANY AUTHORIZED USERS, AND AGREE TO HOLD US AND OUR LICENSORS HARMLESS FROM ANY CLAIMS ARISING DUE TO ACTIONS TAKEN BY US AND/OR OUR LICENSORS DURING OR AS A RESULT OF SUCH INVESTIGATIONS, OR FROM ANY SUBSEQUENT ACTIONS ARISING FROM SUCH INVESTIGATIONS OR OTHER ACTIONS CONDUCTED BY US, LAW ENFORCEMENT BODIES, REGULATORY AGENCIES, OR ANY OTHER PARTIES.

10. Privacy and Security

10.1. Privacy.

We care about your privacy. By accessing and/or using the Products and Services, you acknowledge and understand that your Information, as well as other information related to your use of the Products and Services, will be collected, used, and disclosed as set forth in our Privacy Policy. You also understand that your Information, as well as other information related to your use of the Products and Services, will be collected, used, transferred to, and processed in the United States and/or any other country in which My Family Bill or its parent, subsidiaries, affiliates, or service providers maintain facilities.

10.2. Security.

My Family Bill cares about the integrity and security of your Information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or to use your Information for improper purposes. You acknowledge that you provide your Information, and authorize third parties to provide your Information, and, if applicable, that of the Authorized Users, at your own risk.

11. Geography Restrictions

The owner of the Site is based in the state of Florida in the United States. We provide the Site for use only by persons located in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, MY FAMILY BILL DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS OR SUITABILITY FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS) AS TO THE SERVICE. MY FAMILY BILL DOES NOT MAKE ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE.

13. Limitation of Liability

MY FAMILY BILL SHALL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND OR NATURE, OR FOR ANY DAMAGES FOR LOSS OF PROFITS, LOSS OR INTERRUPTION OF BUSINESS, LOSS OF USE, LOSS OF DATA, LOSS OF OTHER INTANGIBLES, LOSS OF SECURITY OF INFORMATION PROVIDED IN CONNECTION WITH THE USE OF THE SERVICE, OR UNAUTHORIZED INTERCEPTION OF ANY SUCH INFORMATION BY THIRD PARTIES, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY), OR OTHERWISE. MY FAMILY BILL’S AGGREGATE LIABILITY FOR DAMAGES IN CONNECTION WITH THESE TERMS AND THE SERVICE, REGARDLESS OF THE FORM OF ACTION GIVING RISE TO SUCH LIABILITY (UNDER ANY THEORY, WHETHER IN CONTRACT, TORT, STATUTORY OR OTHERWISE), SHALL NOT EXCEED UNDER ANY CIRCUMSTANCES THE AGGREGATE AMOUNT OF FEES PAID BY YOU TO US UNDER THESE TERMS DURING THE PRIOR TWELVE (12) MONTHS.

14. Indemnification

You agree to indemnify, defend, and hold harmless My Family Bill from and against any and all losses and threatened losses arising from, in connection with, or based on allegations whenever made of, any of the following: your breach of these Terms, your use of the Service, any claim that your use of the Service violates any applicable law, or any claim arising out of your negligent acts or omissions. This obligation will survive any termination of these terms or your My Family Bill Account. You will cooperate fully as reasonably required in defense of any claim identified under this section. You acknowledge that damages from improper use of the Service may be irreparable; therefore, My Family Bill is entitled to seek equitable relief in addition to all other remedies. My Family Bill reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

15. Governing Law

Any dispute, claim, or cause of action arising from the Service or these Terms (“Dispute”) shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions.

16. Entire Agreement

These Terms, including My Family Bill’s Privacy Policy, constitute the Entire Agreement and understanding between you and us relating to the Service and cancel and supersede any prior or contemporaneous agreements and other communications between you and us, whether written or oral, to the extent they relate in any way to the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in effect.

17. Amendments

My Family Bill may, in its sole discretion, amend these Terms at any time by posting a revised version on the Service. The effective date of any amendments to these Terms will be the date the revised version of these Terms is posted on the Service. By accessing or using the Service after the effective date of any amendments to these Terms, you agree to be bound by the revised version of these Terms.
